1. Acceptance of Terms

By purchasing products through PixelArcade, you agree to these Terms and Conditions of Sale ("Terms") without reservation. These Terms supersede any prior agreements or communications.

2. Products and Availability

Products listed on PixelArcade are described as accurately as possible and are subject to availability. PixelArcade is not liable for typographical errors or inaccuracies in descriptions, and reserves the right to modify product details or discontinue items at any time.

3. Orders

The information provided by the customer ("Customer") during the order process is binding. PixelArcade is not responsible for errors in the Customer's information (e.g., shipping address or contact details) that may result in delivery delays or failure.

4. Pricing and Payment

• Prices are listed in US dollars ($) and exclude applicable taxes. Taxes (e.g., sales tax) will be calculated based on the shipping address.
• PixelArcade reserves the right to adjust prices at any time.
• Payment must be made in full at the time of order via accepted payment methods (e.g., credit card, PayPal).

5. Shipping and Delivery

• Products are shipped to the address provided at the time of purchase. PixelArcade is not responsible for delays caused by incorrect addresses or issues with the carrier.
• Risk of loss transfers to the Customer once the product leaves our facility.

6. Right to Return

PixelArcade does not accept returns for reasons of "change of mind" or dissatisfaction unless required by applicable law. For defective products, see Section 7.

7. Warranties and Limitation of Liability

• Products are covered by a limited warranty against manufacturing defects for 30 days from delivery.
• To qualify for a return or replacement, the Customer must:
  • Provide proof of purchase.
  • Notify PixelArcade of the defect within the warranty period.
• PixelArcade’s liability is limited to the repair, replacement, or refund of the defective item.

8. Return and Refund Policy

8.1 Conditions for Return

• Returns are only accepted for defective products or incorrect shipments.
• The product must:
  • Be in its original condition, with all accessories and packaging intact.
  • Show no signs of misuse, damage, or tampering.

8.2 Process for Returns

• Contact PixelArcade support at support@pixelarcade.com with your order number and reason for return.
• Approved returns will receive a Return Merchandise Authorization (RMA) number and instructions.

8.3 Refunds

• Refunds will be issued for defective items returned in accordance with these Terms.
• Non-defective returns, if accepted at PixelArcade’s discretion, may be subject to a restocking fee of up to 20%.

8.4 Return Shipping Costs

• Defective products or shipping errors: PixelArcade covers return shipping costs.
• Non-defective returns (if approved): The Customer bears all return shipping costs.

8.5 Exceptions

• No returns or refunds on personalized products, digital downloads, or items marked as "final sale."
• Unauthorized returns or items that do not meet the conditions outlined above will not be accepted or refunded.

9. Intellectual Property

All content on PixelArcade’s website, including images, text, and designs, is the exclusive property of PixelArcade. Unauthorized reproduction, use, or distribution is prohibited.

10. Privacy Policy

PixelArcade collects and processes personal data in compliance with applicable U.S. laws, including the California Consumer Privacy Act (CCPA). For more information, refer to our Privacy Policy.

11. Governing Law and Dispute Resolution

• These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles.
• Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA), unless the parties agree to an alternative method.
